When you visit the website

When you submit an inquiry via our website, follow up may be made via phone call including using an auto dialing phone system.  By providing consent, you agree to be contacted by us even if your name appears on the Federal Do Not Call List or a State Do Not Call List.

Your consent to receive phone calls is NOT a condition of purchasing any goods or services from Tri-State Water, Power & Air. You may receive a quote, purchase products, or request services without consenting to receive calls.

How to Opt Out

Program Description

Tri-State Water, Power & Air operates an SMS messaging program (“Program”) to communicate with customers and prospective customers who have opted in to receive text messages. Messages may include, but are not limited to:

  • Appointment reminders, scheduling confirmations, and updates
  • Service notifications and dispatching information
  • Promotional offers, discounts, and special announcements
  • Company news, product information, and educational content
  • Customer service communications and follow-ups
  • Responses to inquiries submitted via our website or phone

Consent and Opt-In

By providing your mobile phone number and affirmatively checking the consent checkbox on our website contact form, submitting a request for a quote, or otherwise affirmatively opting in, you expressly consent to receive recurring automated and non-automated SMS/text messages from Tri-State Water, Power & Air at the mobile number you provide.

Message Frequency

Message frequency will vary based on your interactions with Tri-State Water, Power & Air and any active services, appointments, or promotions. You may receive up to ten (10) messages per month, though actual frequency may be higher or lower depending on your account activity and the nature of your inquiry.

Message and Data Rates

Message and data rates may apply. Standard message and data rates charged by your mobile carrier may apply to all SMS messages sent to and received from Tri-State Water, Power & Air. Tri-State Water, Power & Air is not responsible for any charges imposed by your mobile carrier. Contact your mobile carrier for information about applicable rates and fees.

How to Opt Out (STOP)

You may opt out of the SMS Program at any time by texting STOP to any SMS message you receive from us. After texting STOP, you will receive a final confirmation message, and no further messages will be sent to your mobile number.

Additional opt-out keywords recognized by our system include: CANCEL, END, UNSUBSCRIBE, QUIT. You may also opt out by contacting us directly at the contact information listed in Section 10 below.

Please note that opting out of promotional SMS messages may not opt you out of transactional or service-related messages (such as appointment confirmations) if you have a pending or active service request.

Supported Carriers

Our SMS Program is compatible with most major U.S. mobile carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, U.S. Cellular, and MetroPCS. Carrier support may vary. We are not liable if your carrier does not support the Program.

Privacy and Data Use

We collect and use your mobile phone number and SMS interaction data in accordance with our Privacy Policy, available at tristatewhywait.com/privacy-policy/. Your information will be used to send you the messages described in this Program, to improve our services, and may be shared with our third-party partners as described below.

Third-Party Data Sharing. By opting in to our SMS Program, you acknowledge and agree that Tri-State Water, Power & Air may share your name, mobile phone number, and related contact information with trusted third-party partners, including but not limited to:

  • Financing and lending partners who may contact you regarding financing options for products and services;
  • Installation and service subcontractors involved in fulfilling your service requests;
  • Marketing and advertising partners who assist us in delivering relevant offers and promotions;
  • Analytics and technology vendors who help us operate and improve our communications programs;
  • Manufacturer partners (such as Generac and KOHLER) whose products you have inquired about or purchased.

These third-party partners may use your information to contact you via phone, email, or SMS regarding products and services that may be of interest to you. Third-party partners are required to handle your information in accordance with their own privacy policies and applicable law. Tri-State Water, Power & Air is not responsible for the privacy practices of third-party partners.

Important Notice Regarding SMS Opt-In Data: Your SMS opt-in consent and originator opt-in data (i.e., the fact that you consented to receive SMS messages from Tri-State Water, Power & Air) will NOT be sold or transferred to third parties for the purpose of allowing those third parties to send you their own SMS marketing messages without your separate, independent consent.

When you choose to receive e-mail from us

From time to time, you may receive e-mailed information about our products, promotions, and services. In addition to receiving e-mail from us, you may occasionally receive special mailings from us and/or from reputable companies whose products may be of interest to you. To remove your name from our e-mail list, please send an email with the words “OPT OUT” in the subject line to unsubscribe@tristatewater.com.

When you enter a contest or complete a survey

Contests and surveys provide us with an opportunity to improve our product offerings and enhance the Site. While we do not release specific information about contest and survey participants, we may provide interested third parties with aggregate data (such as user demographics) and may occasionally e-mail our contest and survey participants about special offers and Site updates. If you prefer not to receive e-mail from us, please send an email with the words “OPT OUT” in the subject line to unsubscribe@tristatewater.com.

When you click on a link in our e-mail communications

In order to create a better electronic community, we may collect specific user profile information, such as the referring URL. This information is used to identify broad demographic trends that may allow us to provide you with information tailored to your interests. You will not be personally identified from this information.

When you leave our site

We have no control over the privacy practices of sites outside of our domain. If you follow a link on the Site to another website, read that website’s privacy policy and contact that website’s administrator with your privacy-related questions.

TCPA and Federal Compliance

Tri-State Water, Power & Air’s SMS Program is intended to comply with all applicable federal laws and regulations, including:

  • The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and its implementing regulations at 47 C.F.R. § 64.1200;
  • The CAN-SPAM Act of 2003, as applicable to electronic communications;
  • The Federal Trade Commission Act (FTC Act), including FTC guidance on deceptive or unfair trade practices;
  • CTIA Messaging Principles and Best Practices; and
  • All applicable state laws governing SMS marketing and communications.

In compliance with the TCPA, your prior express written consent is required before we send you any marketing or promotional phone calls or text messages using an automated telephone dialing system (ATDS) or an artificial or prerecorded voice.
